The controversy began when Alito stated, “No provision in the Constitution gives them the authority to regulate the Supreme Court—period.” Clearly, Alito holds a strong opinion on the matter, but according to Senator Dick Durbin, chairman of the Senate Judiciary Committee, this violates the court’s Statement on Ethics Principles and Practices. Durbin has written a letter to Chief Justice John Roberts, outlining his concerns and requesting appropriate action.

Durbin argues that Alito’s public commentary creates the “appearance of impropriety in the minds of reasonable members of the public.” By publicly taking a position on the constitutionality of the bill, Alito may have compromised the impartiality and neutrality expected of a Supreme Court Justice. This perceived violation of ethics rules has fueled the demand for Alito’s recusal from certain future cases.

The letter sent by Durbin was signed by 10 Democratic members of the Judiciary Committee, leaving out only Senator Jon Ossoff of Georgia. The senators assert that Alito’s association with attorney David Rivkin, a co-author of the Wall Street Journal article, further amplifies the need for recusal. They argue that Rivkin’s access to Alito and his efforts to help Alito express his personal grievances could raise doubts about Alito’s ability to fairly discharge his duties in any case involving Rivkin.

Interestingly, Rivkin represents one of the parties in a tax case currently pending before the Supreme Court, known as Moore v. United States. It is conceivable that Rivkin could represent other clients before the court in the future as well. Given this connection, the senators insist that Alito must recuse himself from any cases involving Rivkin to maintain the integrity and fairness of the judicial process.

It is important to note that both David Rivkin and a spokesperson for the Supreme Court have not yet responded to Insider’s request for comment. However, the implications of this controversy are significant, as they bring into question the ethical conduct of a Supreme Court Justice and the need for transparency and fairness within the judiciary. The demand for Alito’s recusal stems from the belief that his comments and association with Rivkin could compromise his ability to make unbiased decisions in relevant cases.
